Terms and Conditions (T&C)
for the sale of tickets to informational events (Patient Days) organized by LipoClinic Dr. Heck GmbH

This is a non-binding English translation provided for convenience. The German-language version of these Terms and Conditions is the legally binding version and shall prevail in case of any discrepancy.
§ 1 Scope and Contracting Parties
(1) These Terms and Conditions (hereinafter “T&C”) apply to all bookings of tickets for informational events (hereinafter “Patient Day” or “Event”) organized by LipoClinic Dr. Heck GmbH, Zeppelinstr. 321, 45470 Mülheim an der Ruhr, Germany (hereinafter “Organizer” or “we”), which are booked via the website www.lipo.clinic or a related online booking form.
(2) The contracting party is the natural person named as participant in the booking form (hereinafter “Participant” or “Customer”). The booking is directed exclusively at consumers within the meaning of § 13 of the German Civil Code (BGB).
(3) Any terms and conditions of the Customer that deviate from, conflict with, or supplement these T&C shall not become part of the contract unless the Organizer expressly agrees to their validity in writing.
§ 2 Description of Services
(1) The subject matter of the contract is paid participation in an informational event on the topic of lipedema and its treatment options (Patient Day), organized by the Organizer at a fixed location and on a fixed date, as described on the respective event landing page.
(2) Participation includes, in particular, access to presentations and personal accounts from former patients, as well as the opportunity for personal exchange with the expert team on site. Purchasing a ticket alone does not entitle the Customer to an individual one-on-one consultation with a physician; the possibility of such a consultation is arranged separately based on appointment availability and communicated to participants by email.
(3) Unless stated otherwise on the respective event page, the ticket price includes complimentary refreshments and snacks during the event.
(4) The Organizer reserves the right to adjust the program of presentations, speakers, or the exact schedule of the event for organizational reasons, provided this is reasonable for the Participant and the overall character of the event is preserved.
(5) The event is a general informational event. It does not replace individual medical consultation, diagnosis, or treatment by a physician and does not constitute an offer to enter into a treatment contract.
§ 3 Conclusion of Contract
(1) The presentation of the event on the website does not constitute a binding offer by the Organizer, but rather a non-binding invitation to the Customer to submit a binding booking for a ticket.
(2) By submitting the online booking form via the button “Book now, subject to payment” (“Jetzt zahlungspflichtig buchen”), the Customer submits a binding offer to enter into a participation agreement.
(3) The contract is concluded once the Organizer accepts the booking by sending a confirmation email to the email address provided by the Customer, or at the latest upon successful processing of payment by the selected payment service provider.
(4) The number of available tickets is limited. Participation can only be guaranteed within existing capacity; if an event is fully booked, the booking form will be deactivated or the conclusion of the contract will be declined. Any amounts already paid will be refunded without delay in such cases.
§ 4 Prices and Payment
(1) The ticket price applicable is the one stated on the event page or in the booking form at the time of booking. All stated ticket prices are final prices inclusive of statutory value-added tax.
(2) Payment is made exclusively via the payment methods offered in the booking form (currently: credit card via Stripe and/or PayPal, including credit card payment offered through PayPal). The ticket price is due immediately upon submission of the booking and is charged directly via the selected payment service provider.
(3) Payment processing is carried out by the respective third-party providers (Stripe Payments Europe, Ltd. and/or PayPal (Europe) S.à r.l. et Cie, S.C.A.), whose own terms of use and privacy policies apply in addition.
(4) The Customer will receive an automatic booking confirmation by email to the address provided, following successful payment.
§ 5 Right of Withdrawal
(1) Consumers generally have a statutory right of withdrawal pursuant to § 355 of the German Civil Code (BGB).
(2) However, pursuant to § 312g para. 2 sentence 1 no. 9 BGB, this right of withdrawal does not apply to contracts for the provision of services related to leisure activities, if the contract provides for a specific date or period of performance. As the Patient Day is an event with a fixed, agreed date and a limited number of participants, the statutory right of withdrawal is excluded.
(3) As the right of withdrawal is excluded, the Customer has no right to unilaterally cancel the booking after the contract has been concluded. A refund of the ticket price will only be made in the cases described in § 6 (Cancellation or postponement by the Organizer).
§ 6 Cancellation, Postponement, or Modification by the Organizer
(1) The Organizer reserves the right to cancel or postpone the event to another date for good cause (e.g., illness of speakers, force majeure, orders by public authorities, insufficient number of participants).
(2) In the event of a cancellation, the Organizer will inform the Customer without delay and refund the ticket price paid in full.
(3) In the event of a postponement, the Customer will be offered the option to transfer the ticket to the new date or to cancel it in exchange for a full refund of the ticket price.
(4) Any further claims by the Customer, in particular for reimbursement of expenses (e.g., travel or accommodation costs), are excluded, unless the Organizer is guilty of intent or gross negligence. § 7 (Liability) remains unaffected.
§ 7 Liability
(1) The Organizer’s liability is unlimited for damages resulting from injury to life, body, or health caused by an intentional or negligent breach of duty, as well as for other damages caused by an intentional or grossly negligent breach of duty or fraudulent intent on the part of the Organizer.
(2) In the event of a slightly negligent breach of material contractual obligations (“Kardinalpflichten”) — i.e., obligations whose fulfillment is essential for the proper execution of the event and on whose observance the Customer may regularly rely — the Organizer’s liability shall be limited to the foreseeable damage typical for this type of contract at the time the contract was concluded.
(3) Otherwise, the Organizer’s liability for slightly negligent breaches of duty is excluded.
(4) The above limitations of liability do not apply to the assumption of guarantees or to claims under product liability law.
(5) To the extent permitted by law, the Organizer assumes no liability for the safety of participants’ personal belongings during the event.
§ 8 Photography and Video Recording
(1) During the event, the Organizer or parties acting on its behalf may take photographs and/or video recordings for documentation and marketing purposes.
(2) Recordings in which individual participants are recognizable and shown prominently will only be used with the separate, express consent of the person concerned, obtained on site. Overview recordings of the event in which persons appear only incidentally in the background are not covered by this provision.
§ 9 Data Protection
Information on the collection and processing of personal data in connection with the booking and conduct of the event can be found in the Privacy Policy at www.lipo.clinic/datenschutz/.
§ 10 Medical Advertising Law / Notice
This event serves to provide general information about the medical condition lipedema and possible treatment methods. It does not constitute advertising for any specific surgical procedure directed at an individually identifiable person and does not replace a medical consultation with a physician.
§ 11 Final Provisions
(1) These T&C are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the country in which the Customer has their habitual residence remain unaffected.
(2) If the Customer is a consumer and, at the time of booking, has their domicile or habitual residence abroad, the following applies in addition: mandatory provisions of the law of that country remain unaffected.
(3) The Organizer is not willing and not obligated to participate in dispute resolution proceedings before a consumer arbitration board. (4) Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions shall remain unaffected.
